Trump Attorney Singles Out Brett Kavanaugh, Predicts He Will ‘Step Up’ in Colorado Ballot Case

A lawyer for former President Donald Trump believes the conservative justices on the U.S. Supreme Court will “step up” in a major case.

Attorney Alina Habba appeared on Fox News’ “Hannity” Thursday night to discuss a case with major implications for the 2024 election. This week, Trump asked the Supreme Court to overturn a ruling from Colorado’s Supreme Court that found he is ineligible to hold office again.

And Habba predicted the nation’s highest court would rule in her client’s favor.

“I think it should be a slam dunk in the Supreme Court. I have faith in them,” she said.

Habba went on to specifically mention Supreme Court Justice Brett Kavanaugh as one of the conservative members who might rule in Trump’s favor:

“You know, people like Kavanaugh, who the president fought for, who the president went through hell to get into place. He’ll step up. Those people will step up.”

Finally, she insisted the ruling will not be “because they’re pro-Trump, but because they’re pro-law because they’re pro-fairness. And the law on this is very clear.”

Conservative commentator John Hasson shared the clip on X, formerly Twitter, and wrote, “Can’t overstate how bad Trump’s attorney is.”

“…that’s a great way to force Kavanaugh to recuse himself,” he argued.

“Someone please get her off television,” another user begged.

MSNBC’s Katie Phang claimed, “Alina Habba [is] saying the quid pro quo part out loud here.”

“This is the worst spokesperson in the history of spokespersons. HOW ON EARTH DO YOU SAY THIS ALOUD, ON TV, EVEN IF YOU’RE THINKING IT?” wrote lawyer A.J. Delgado.

In December, Colorado’s Supreme Court ruled Trump is ineligible to appear on the ballot in the state due to his actions surrounding the Jan. 6 riot at the U.S. Capitol. It found he “engaged in insurrection” that day and was barred from holding office again due to Section 3 of the 14th Amendment.

Trump’s appeal to the U.S. Supreme Court argues, “This Court should grant certiorari to consider this question of paramount importance, summarily reverse the Colorado Supreme Court’s ruling, and return the right to vote for their candidate of choice to the voters.”
