POLICE Scotland is taking Kate Forbes to court over a bid to expand the public inquiry into dad Sheku Bayoh’s custody death.
Lawyers for the family of the 31-year-old, who was restrained by six cops, want her to rule that it can examine if any officers should have been prosecuted.
But the force wants a judicial review in the Court of Session amid claims the process being led by Deputy First Minister Ms Forbes has seen “a failure to share relevant material”.

Alan Speirs called Mr Bayoh’s 2015 death in Kirkcaldy, Fife, a “terrible tragedy”.
He added: “We have written to Ms Forbes to outline an unfair approach to the proposed extension to the terms of reference.”
The probe has already cost taxpayers £23.7million.
The Scottish Government said: “It is inappropriate to comment while proceedings are underway.”
In 2022, we revealed that Mr Bayoh’s girlfriend announced her engagement – days after she told a public inquiry that she had dreamed she would grow old together with the tragic gas engineer.
Collette Bell, 33, revealed on Facebook that partner William Morrison had proposed.
She showed off her new engagement ring to pals.
And she said her hubby-to-be “absolutely swept” her off her feet when he proposed on one knee.
Ms Bell said: “Of course I said yes. It was the perfect proposal and I absolutely love my ring.”
She added: “Forever has a nice ring to it.”
